California notaries public are prohibited from performing any duties that may be construed as the practice of law. Among these acts are: preparation, drafting, or selection or determination of the kind of any legal document, or giving advice in relation to any legal documents or matters (CA Notary Public Handbook, 2012). Remember that a Notary Public just notarizes your documents and it is your responsibility to select and prepare them.

Notary Public

The main tasks of a Notary Public are to witness and authenticate signatures, administer oaths, verify signatures, and take affidavits. Notary Public is utilized by state governing bodies to prevent fraud and theft within public matters. Each Notary receives a personal identification number, which will avoid fraudulent use of the seal, as well as provide a record of that notary public's activity.

Loan Signing

With Swift Mobile Notary loan signing service you receive prompt, professional service at your location. The services include a brief explanation of key documents such as Right to Cancel, HUD Settlement Statement; Note, Truth in Lending, Deed of Trust, Riders, First Pay Letter, etc.. More details such as calculations of lender credits, interest, policies, escrow and title fees are best answered by the loan officer, mortgage broker, agent or escrow officer.

Copy Certification

A certified copy is a notarial act in which a Notary certifies that a photocopy of an original document is a complete and true reproduction of the original document.

A Notary may only certify copies of powers of attorney (Probate Code section 4307) and his or her notary public journal (Government Code sections 8205(a)(4), 8206(b)(1), and 8206(e)).

Apostille

An Apostille is a certificate that authenticates the origin of a public document (a birth, marriage or death certificate, a judgment, a notarial attestation, etc.). Apostilles can only be issued for documents issued in one country party to the Hague Apostille Convention and that are to be used in another courtly which is also a party to the Hague Apostille Convention. Apostilles are strictly for the use of pubic documents abroad.
